1. Acceptance of these Terms
Welcome to pivotdebt.com (the "Website"), operated by Pivot Debt LLC ("Pivot Debt," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Website. By accessing or using the Website you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Website.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use the Website. If you use the Website on behalf of another person or organization, you represent that you are authorized to bind them to these Terms.
3. What Pivot Debt does — and doesn't do
Pivot Debt is a marketing and referral service. We collect the information you provide and forward it to one or more third-party debt relief providers ("Partners"). We are not a lender, credit broker, debt settlement company, credit counselor, or law firm. We do not negotiate with creditors, provide credit, make credit decisions, or give legal, tax, or financial advice. Any relationship you enter into with a Partner is solely between you and that Partner and is governed by that Partner's own terms. Submitting information through the Website does not guarantee that you will qualify for, or be accepted into, any program. See our Advertising Disclosure for how we are compensated.
4. Consent to access your credit report
By submitting your information, you provide written instruction under the Fair Credit Reporting Act authorizing Pivot Debt and the Partners we share your information with (currently: [PARTNER LIST]) to obtain your consumer credit report, credit score, and related information from one or more consumer reporting agencies. This is used to verify your identity, evaluate your eligibility, and prepare quotes or program estimates. You agree these parties have a permissible purpose to obtain your report. Where noted on the Website, the initial review is a soft inquiry that does not affect your credit score; a Partner may perform a separate hard inquiry, with your consent, before enrolling you in a program. Partners may also use third-party services to verify information you provide, including your Social Security number, address, phone number, bank account information, and employment history.
5. Consent to be contacted (TCPA) and electronic communications
By submitting your information on pivotdebt.com, you expressly consent to receive marketing and servicing calls, text (SMS/MMS) messages, and emails from Pivot Debt and from the Partner(s) you are matched with, at the phone number and email address you provide, including calls and texts made using an automatic telephone dialing system, prerecorded or artificial voice messages. Your consent is not a condition of purchasing any goods or services. Message frequency varies; standard message and data rates may apply. You will only be contacted by the specific Partner(s) you are matched with based on your inquiry. You may revoke consent at any time by replying STOP to any text message, or by emailing privacy@pivotdebt.com. You also agree to receive disclosures and communications from us electronically.
6. Changes to these Terms
We may change these Terms at any time by posting an updated version on the Website. Your continued use after a change is posted means you accept the revised Terms.
7. License to use the Website
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Website for your personal, non-commercial purposes. Any other use is prohibited.
8. Intellectual property
All content on the Website — text, designs, graphics, logos, and software — is owned by Pivot Debt or its licensors and protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Website without our prior written consent.
9. Information you provide

We do not warrant that the Website will be uninterrupted, error-free, or secure, or that any example figures shown reflect the results you will obtain.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PIVOT DEBT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE. Our total liability for all claims relating to the Website will not exceed $100.
14. Indemnification
You agree to defend, indemnify, and hold harmless Pivot Debt and its affiliates, officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Website, your violation of these Terms, or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any dispute arising out of these Terms or the Website.
16. Severability and entire agreement
If any provision of these Terms is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Advertising Disclosure, are the entire agreement between you and Pivot Debt regarding the Website.
